John Mentz was convicted of two counts of bank robbery, in violation of 18 U.S.C. 2113(a)(1982).*fn1 He was found guilty of robbing the Society National Bank on August 4, 1986, and the First National Bank of Ohio four days later. On appeal, Mentz raises two issues for our consideration. First, he contends that the district Court's jury instruction improperly removed an essential element of the bank robbery charge from the jury's consideration. Second, he contends that he was not brought to trial within the time limits set by the Speedy Trial Act, 18 U.S.C. §§ 3161-74 (1982). Finding merit to Mentz's contentions, we reverse.
